Terms, Conditions, and Policies

The agreement that governs your use of Crash N Go as a Guest, Host, or visitor. Use the contents list to jump to any section.

1.Introduction

Welcome to Crash N Go.

These Terms and Conditions ("Terms," "Agreement," or "Terms and Conditions") constitute a legally binding agreement between you ("you," "your," "User," "Guest," or "Host") and Crash N Go ("Crash N Go," "we," "us," or "our").

Crash N Go operates an online marketplace and technology platform that enables property owners, property managers, authorized representatives, and other approved accommodation providers ("Hosts") to advertise accommodations and enables travelers and other approved users ("Guests") to search for, request, reserve, and stay at those accommodations.

Crash N Go is a marketplace and technology platform. Unless expressly stated otherwise in a particular transaction, Crash N Go does not own, lease, manage, control, or physically operate the accommodations listed by Hosts.

By creating an account, accessing the Platform, listing a property, making a reservation, accepting a reservation, communicating through the Platform, or otherwise using Crash N Go, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you must not use Crash N Go.

2.Definitions

For purposes of these Terms:

2.1 "Platform" — Means the Crash N Go website, mobile application, software, services, communications systems, payment systems, customer support systems, and related technology.

2.2 "Host" — Means an individual, business, property owner, property manager, authorized representative, or other person approved by Crash N Go to list an accommodation.

2.3 "Guest" — Means a person who searches for, requests, books, rents, or stays at an accommodation through Crash N Go.

2.4 "Accommodation" — Means a property, room, house, condominium, apartment, villa, resort unit, hotel-type accommodation, vacation rental, or other lodging space listed through Crash N Go.

2.5 "Listing" — Means an Accommodation advertisement or property page published on Crash N Go.

2.6 "Reservation" — Means a booking accepted and confirmed through the Crash N Go Platform.

2.7 "Booking Amount" — Means the amount charged to a Guest for a Reservation, including applicable accommodation charges, Platform fees, taxes, cleaning charges, service charges, and other disclosed amounts.

2.8 "Host Payout" — Means the amount payable to a Host after deduction of Crash N Go commissions, fees, taxes, refunds, chargebacks, adjustments, penalties, or other amounts properly chargeable under these Terms.

2.9 "Platform Fee" — Means a fee charged by Crash N Go for facilitating the use of its Platform and services.

2.10 "Cancellation" — Means the cancellation of a Reservation by a Guest, Host, or Crash N Go.

2.11 "Major Disruption" — Means an event substantially preventing a Guest from using an Accommodation, such as serious property damage, government evacuation, major safety issue, or another event recognized under Crash N Go's applicable disruption policy.

3.Eligibility

To use Crash N Go, you must:

  • Be legally capable of entering into a binding agreement.
  • Provide accurate registration information.
  • Comply with applicable laws.
  • Be at least 18 years old unless Crash N Go expressly permits otherwise in accordance with applicable law.
  • Have authority to enter into any transaction you undertake through the Platform.
  • Not be prohibited from using online accommodation services under applicable law.

Hosts must additionally have the legal right, authorization, license, permit, leasehold right, or other authority necessary to offer the Accommodation.

Crash N Go may require evidence of identity, ownership, management authority, permits, licenses, or other documentation.

4.Account Registration

Users may be required to create an account. You agree to:

  • provide truthful information;
  • maintain accurate information;
  • protect your password;
  • maintain control over your account;
  • notify Crash N Go of unauthorized account access;
  • not transfer your account to another person;
  • not create multiple accounts to evade restrictions;
  • not impersonate another person.

You are responsible for activity conducted through your account unless the activity resulted from circumstances beyond your reasonable control and you promptly notify Crash N Go.

Crash N Go may require identity verification before allowing certain activities.

5.Identity Verification

Crash N Go may require Hosts and/or Guests to provide identification information. Verification may include:

  • government-issued identification;
  • selfie or facial verification;
  • telephone verification;
  • email verification;
  • payment verification;
  • property ownership or management documentation;
  • business registration;
  • permits or licenses;
  • other information reasonably necessary to verify identity or eligibility.

Verification does not constitute an endorsement, guarantee, certification, or warranty by Crash N Go regarding the User.

A verified badge means only that the applicable verification process has been completed according to Crash N Go's procedures.

6.Crash N Go's Role

Crash N Go operates as a marketplace and technology intermediary. Unless expressly stated otherwise, Crash N Go:

  • provides technology allowing Hosts and Guests to discover and communicate with each other;
  • facilitates reservations;
  • may facilitate payments;
  • provides customer support;
  • may conduct identity and listing verification;
  • may establish safety and quality standards;
  • may enforce Platform rules.

Crash N Go does not guarantee:

  • the accuracy of every Listing;
  • the quality of every Accommodation;
  • the legality of every Host's right to offer an Accommodation;
  • the safety of every Accommodation;
  • the conduct of every User;
  • the uninterrupted availability of an Accommodation;
  • the availability of any particular Listing;
  • that a Guest or Host will comply with an agreement.

Hosts remain responsible for their Listings and Accommodations. Guests remain responsible for their conduct and compliance with Host rules.

7.Host Requirements

Hosts must:

  • Have legal authority to list the Accommodation.
  • Provide truthful information.
  • Accurately describe the Accommodation.
  • Use accurate photographs.
  • Disclose material limitations.
  • Disclose applicable house rules.
  • Disclose applicable fees.
  • Maintain reasonable cleanliness and safety.
  • Comply with applicable Philippine laws and local regulations.
  • Maintain required permits and licenses.
  • Honor confirmed Reservations.
  • Provide reasonable access to confirmed Guests.
  • Respond to Guest communications within a reasonable time.
  • Not discriminate unlawfully.
  • Not misrepresent the Accommodation.
  • Not intentionally manipulate reviews.
  • Not collect unauthorized payments outside the Platform.
  • Not request sensitive information from Guests unless legally necessary.
  • Notify Crash N Go of material changes affecting a Reservation.

8.Host Property Authorization

A Host represents and warrants that:

  • the Host owns the Accommodation or has authorization to operate it;
  • listing the Accommodation does not violate a lease;
  • listing the Accommodation does not violate condominium rules;
  • listing the Accommodation does not violate homeowners' association rules;
  • listing the Accommodation does not violate zoning or local regulations;
  • necessary permits and licenses have been obtained where required;
  • all applicable taxes and governmental obligations are the Host's responsibility unless otherwise expressly agreed.

Crash N Go may remove a Listing if it receives credible evidence that the Host lacks authority to offer the Accommodation.

9.Listing Requirements

Every Listing must accurately disclose, as applicable:

  • location;
  • type of Accommodation;
  • number of bedrooms;
  • number of beds;
  • maximum occupancy;
  • bathrooms;
  • amenities;
  • check-in time;
  • check-out time;
  • minimum stay;
  • maximum stay;
  • house rules;
  • cancellation policy;
  • cleaning fees;
  • additional fees;
  • security deposit requirements;
  • accessibility information;
  • restrictions;
  • material hazards;
  • applicable taxes;
  • other material conditions.

Hosts must update Listings when material information changes.

10.Photos and Content

Hosts are responsible for ensuring that photographs and other Listing materials:

  • accurately represent the Accommodation;
  • are not materially misleading;
  • do not infringe third-party rights;
  • do not contain unauthorized personal information;
  • do not falsely represent amenities.

By uploading Listing content, the Host grants Crash N Go a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, resize, modify, and promote the content for Platform, marketing, advertising, and business purposes.

The Host represents that it has the necessary rights to grant this license.

11.Guest Responsibilities

Guests must:

  • Provide accurate information.
  • Use the Accommodation only for lawful purposes.
  • Follow the Host's disclosed house rules.
  • Respect neighbors and surrounding communities.
  • Respect occupancy limits.
  • Not exceed the approved number of Guests.
  • Not hold unauthorized parties or events.
  • Not engage in illegal activity.
  • Not damage the Accommodation.
  • Not remove property belonging to the Host.
  • Not interfere with security devices.
  • Not use the Accommodation for unauthorized commercial purposes.
  • Pay all applicable charges.
  • Report material problems promptly.
  • Leave the Accommodation in reasonable condition.

12.Prohibited Guest Conduct

Unless expressly authorized by the Host, Guests may not:

  • host parties;
  • conduct events;
  • exceed occupancy limits;
  • bring unauthorized overnight visitors;
  • smoke where prohibited;
  • use illegal drugs;
  • engage in criminal activity;
  • use the property for prostitution or commercial sexual activity;
  • use the property for fraud;
  • use the property for unauthorized filming or production;
  • damage the property;
  • tamper with smoke detectors or safety equipment;
  • disable security systems;
  • harass neighbors;
  • create unreasonable noise;
  • violate local laws;
  • engage in discriminatory or abusive conduct.

Crash N Go may immediately suspend or terminate a User for serious violations.

13.Prohibited Host Conduct

Hosts may not:

  • falsely advertise an Accommodation;
  • accept a Reservation and intentionally refuse to honor it without legitimate reason;
  • discriminate unlawfully;
  • misrepresent availability;
  • impose undisclosed mandatory fees;
  • demand unauthorized off-platform payments;
  • harass Guests;
  • threaten Guests;
  • retaliate against Guests for reviews;
  • manipulate reviews;
  • enter an Accommodation during a Guest's stay without lawful or emergency justification;
  • use undisclosed surveillance devices in private areas;
  • request prohibited personal information;
  • use Crash N Go to facilitate unlawful activity.

14.Surveillance Devices

Hosts must comply with applicable privacy laws regarding cameras, recording equipment, smart devices, and monitoring systems.

Hidden surveillance devices are prohibited.

A Host must disclose any permitted recording or monitoring device in accordance with applicable law and Crash N Go policy.

Recording devices must not be placed in areas where Guests reasonably expect privacy, including bedrooms or bathrooms.

Crash N Go may immediately suspend a Listing for suspected serious privacy violations.

15.Reservations

A Reservation becomes binding when Crash N Go confirms the booking through the Platform. A Reservation may contain:

  • Accommodation;
  • Host;
  • Guest;
  • dates;
  • number of Guests;
  • check-in time;
  • check-out time;
  • Booking Amount;
  • fees;
  • cancellation policy;
  • house rules;
  • special conditions.

The Host must honor confirmed Reservations unless cancellation is permitted under these Terms or exceptional circumstances apply.

16.Pricing

Hosts determine the base price of their Listings unless Crash N Go offers promotional pricing or other arrangements. The total amount shown to a Guest may include:

  • nightly rate;
  • additional Guest charges;
  • cleaning fee;
  • Platform fee;
  • taxes;
  • security deposit;
  • other disclosed charges.

All mandatory charges should be disclosed before the Guest confirms a Reservation.

Crash N Go may change Platform fees subject to applicable law and reasonable notice.

17.Payments

Crash N Go may use third-party payment processors. Guests authorize Crash N Go and its payment providers to charge the applicable payment method for:

  • Booking Amounts;
  • Platform fees;
  • authorized additional charges;
  • cancellation charges;
  • damage charges;
  • penalties;
  • other amounts properly payable under these Terms.

Payment processing may be subject to the terms of the applicable payment provider.

Crash N Go is not responsible for failures caused solely by a Guest's bank, card issuer, payment processor, or other external payment provider.

18.Host Payouts

Subject to applicable deductions, Crash N Go will remit Host payouts according to the payout schedule displayed to the Host. Crash N Go may deduct:

  • Platform commissions;
  • refunds;
  • chargebacks;
  • payment processing costs where applicable;
  • taxes required to be withheld;
  • Guest compensation;
  • damage-related amounts;
  • cancellation-related amounts;
  • penalties;
  • amounts owed by the Host.

Crash N Go may delay or suspend a payout when reasonably necessary to investigate suspected fraud, a dispute, chargeback, cancellation, safety issue, or legal requirement.

19.Damage Charges

Guests are responsible for damage they cause to an accommodation beyond ordinary wear and tear. If a Host submits a damage claim, Crash N Go may request:

  • photographs;
  • invoices;
  • receipts;
  • repair estimates;
  • police reports;
  • other evidence.

Crash N Go may review the claim and determine whether the claim is supported under Platform procedures.

Crash N Go may charge a Guest's authorized payment method for approved amounts, subject to applicable law and applicable dispute procedures.

Guests will be given a reasonable opportunity to respond to a damage claim.

20.Security Deposits

Where applicable, a Host may require a security deposit if disclosed before booking. A security deposit may be used for:

  • property damage;
  • missing property;
  • excessive cleaning;
  • unpaid authorized charges;
  • other legitimate losses caused by the Guest.

A security deposit does not eliminate the Guest's responsibility for damages exceeding the deposit.

21.Cancellation Policy

The cancellation policy applicable to each Reservation will be displayed before the Guest completes the booking. Unless a Listing specifies another approved cancellation policy, Crash N Go may use the following standard policies.

STANDARD FLEXIBLE POLICY

A Guest receives a full refund of the accommodation amount if the Guest cancels at least 48 hours before check-in, subject to any disclosed non-refundable fees or charges permitted by law. If cancellation occurs less than 48 hours before check-in, the Host may retain the equivalent of the first night plus applicable disclosed fees, with the remainder refunded where applicable.

MODERATE POLICY

A Guest receives:

  • 100% refund if cancelled at least 7 days before check-in;
  • 50% refund of eligible accommodation charges if cancelled 3–7 days before check-in;
  • no refund for cancellation less than 3 days before check-in, except where another policy or law applies.

STRICT POLICY

A Guest receives:

  • 100% refund if cancelled within 24 hours after booking, provided the booking was made at least 14 days before check-in;
  • 50% refund if cancelled at least 7 days before check-in;
  • no refund for cancellation less than 7 days before check-in.

The applicable policy displayed on the Listing at the time of booking controls. Crash N Go may offer Hosts additional cancellation-policy options.

22.Guest Cancellation

When a Guest cancels:

  • The Platform will calculate the refund based on the applicable cancellation policy.
  • The refund may be reduced by non-refundable amounts expressly disclosed at booking.
  • Payment-provider processing may affect the timing of the refund.
  • A Guest may be entitled to additional relief where required by law or under Crash N Go's Major Disruption Policy.

The cancellation timestamp will generally be based on the time recorded by Crash N Go's system.

23.Host Cancellation

Hosts should not cancel confirmed Reservations except where permitted. If a Host cancels without a valid reason, Crash N Go may:

  • issue a full refund to the Guest;
  • assist the Guest in finding alternative accommodation;
  • charge the Host an administrative cancellation fee;
  • reduce or withhold applicable payout amounts;
  • temporarily suspend the Listing;
  • reduce Listing visibility;
  • remove the Listing;
  • suspend or terminate the Host account.

Repeated Host cancellations may result in permanent removal from Crash N Go.

24.Host Cancellation Penalty

Unless otherwise stated by Crash N Go, the Platform may impose a cancellation penalty of up to the amount or percentage of the Reservation value specified by Crash N Go. The penalty may be waived when the Host demonstrates circumstances reasonably outside the Host's control, such as:

  • serious property damage;
  • government order;
  • major natural disaster;
  • serious emergency;
  • unsafe conditions;
  • material fraud;
  • other circumstances approved by Crash N Go.

25.No-Show Policy

If a Guest fails to arrive for a Reservation without cancelling, the Reservation will generally be treated as a no-show. The refund will be determined by the applicable cancellation policy.

If a Host fails to provide access at the scheduled check-in time, the Host may be considered responsible for a Host no-show.

26.Early Checkout

If a Guest leaves early after check-in, the Guest generally remains responsible for the applicable Reservation charges unless:

  • the Host agrees otherwise;
  • the cancellation policy provides otherwise;
  • Crash N Go determines that the Accommodation materially fails to meet the Listing description;
  • a Major Disruption applies;
  • applicable law provides otherwise.

27.Major Disruption Policy

Crash N Go may provide a special cancellation or relocation remedy when an event substantially prevents use of the Accommodation. Examples may include:

  • government evacuation;
  • major natural disaster;
  • serious fire;
  • major flooding;
  • property becoming legally inaccessible;
  • serious health or safety hazard;
  • other extraordinary circumstances recognized by Crash N Go.

Crash N Go will evaluate situations individually. A Guest should provide evidence when reasonably requested.

Minor inconveniences, ordinary weather conditions, personal schedule changes, transportation delays, change of plans, or dissatisfaction with neighborhood conditions generally do not qualify automatically.

28.Property Does Not Match Listing

If an Accommodation materially differs from its Listing, the Guest should contact Crash N Go promptly. Examples may include:

  • materially different property;
  • property unavailable;
  • materially inaccurate number of bedrooms;
  • serious undisclosed safety problem;
  • essential advertised amenity unavailable;
  • property substantially unclean;
  • unauthorized occupancy;
  • inability to access the property.

Crash N Go may provide:

  • correction of the problem;
  • partial refund;
  • relocation assistance;
  • full refund;
  • another appropriate remedy.

The remedy will depend on the seriousness of the issue, evidence, timing, availability, and applicable law.

29.Check-In and Check-Out

Guests must follow the Host's stated check-in and check-out procedures.

Hosts must provide reasonably accurate check-in instructions.

Guests should notify the Host promptly of access problems.

Hosts may not impose new mandatory check-in conditions after booking unless reasonably necessary and legally permitted.

30.House Rules

Hosts may establish reasonable house rules. House rules must:

  • be disclosed before booking;
  • be lawful;
  • not materially conflict with these Terms;
  • not unlawfully discriminate;
  • not contain deceptive provisions.

A Guest's violation of house rules may result in cancellation, removal, damage charges, or account action.

31.Reviews and Ratings

After a Reservation, Guests and Hosts may be permitted to submit reviews. Reviews must be:

  • truthful;
  • relevant;
  • based on genuine experiences;
  • non-threatening;
  • non-discriminatory;
  • non-defamatory;
  • free from prohibited personal information.

Users may not:

  • purchase reviews;
  • offer compensation for positive reviews;
  • threaten negative reviews;
  • manipulate ratings;
  • post reviews for stays that did not occur.

Crash N Go may remove content violating its policies. Crash N Go does not guarantee that every review is accurate.

32.Discrimination

Crash N Go prohibits unlawful discrimination.

Users must comply with applicable Philippine laws and Platform policies regarding discrimination.

Crash N Go may investigate complaints and take action against accounts engaging in discriminatory conduct.

33.Safety

Users must act reasonably to protect their own safety and the safety of others.

Hosts should disclose known material hazards.

Guests should immediately report serious safety concerns.

Crash N Go may suspend a Listing while investigating a serious safety issue.

34.Emergencies

In an emergency, Users should contact appropriate emergency services and take reasonable steps to protect life and safety.

Crash N Go may disclose information to emergency responders or authorities where reasonably necessary or legally required.

35.Illegal Activities

Crash N Go may suspend or terminate accounts involved in:

  • fraud;
  • theft;
  • money laundering;
  • trafficking;
  • exploitation;
  • illegal drug activity;
  • violence;
  • threats;
  • unauthorized financial activity;
  • identity theft;
  • unlawful surveillance;
  • other criminal conduct.

Crash N Go may cooperate with lawful government investigations.

36.Off-Platform Transactions

Users must not intentionally circumvent Crash N Go's Platform by moving a Reservation off-platform to avoid legitimate Platform fees or safeguards. Examples include:

  • requesting payment directly to a personal bank account;
  • directing Guests to book directly to avoid Platform fees;
  • sharing external payment instructions for the purpose of bypassing Crash N Go;
  • cancelling a Platform Reservation solely to complete the same transaction outside the Platform.

Crash N Go may suspend accounts engaging in systematic fee circumvention.

37.Personal Information and Privacy

Crash N Go collects and processes personal information in accordance with applicable privacy laws, including Republic Act No. 10173, the Data Privacy Act of 2012.

The Data Privacy Act requires processing to follow principles including transparency, legitimate purpose, and proportionality and provides data subjects with rights concerning their personal information. Crash N Go may process information for:

  • account creation;
  • identity verification;
  • reservation processing;
  • payment processing;
  • customer support;
  • fraud prevention;
  • safety;
  • dispute resolution;
  • legal compliance;
  • marketing where permitted;
  • Platform improvement.

Users should review Crash N Go's separate Privacy Policy for detailed information.

38.Electronic Communications

By using Crash N Go, you consent to receiving electronic communications relating to:

  • Reservations;
  • account activity;
  • payments;
  • cancellations;
  • security;
  • customer support;
  • Platform changes.

Electronic communications and electronic contracts may be legally recognized under Philippine law, including the Electronic Commerce Act.

Marketing communications may be subject to applicable consent and opt-out requirements.

39.Intellectual Property

Crash N Go owns or licenses the Platform's:

  • software;
  • trademarks;
  • logos;
  • branding;
  • interface;
  • databases;
  • graphics;
  • written materials;
  • proprietary systems.

Users may not copy, reproduce, distribute, reverse engineer, scrape, sell, or exploit Crash N Go intellectual property without written authorization.

40.User Content

Users retain ownership of content they lawfully own.

By submitting content to Crash N Go, the User grants Crash N Go the rights reasonably necessary to operate, promote, display, distribute, and improve the Platform.

Users are responsible for ensuring they have the rights necessary to submit their content.

41.Fraud Prevention

Crash N Go may use automated and manual systems to detect:

  • fraudulent accounts;
  • stolen payment methods;
  • fake Listings;
  • identity fraud;
  • suspicious Reservations;
  • review manipulation;
  • chargeback abuse;
  • account takeover;
  • unusual transaction patterns.

Crash N Go may delay transactions while investigating suspected fraud.

42.Chargebacks

If a Guest improperly reverses a legitimate payment through a card issuer or payment provider, Crash N Go may:

  • investigate;
  • provide evidence to the payment provider;
  • suspend the account;
  • recover amounts owed;
  • deduct amounts from future refunds or payouts where legally permitted.

Nothing in this provision limits a User's lawful rights against fraudulent or unauthorized charges.

43.Account Suspension

Crash N Go may suspend an account where it reasonably believes that the User:

  • violated these Terms;
  • violated a law;
  • created a safety risk;
  • engaged in fraud;
  • provided false information;
  • received serious complaints;
  • failed identity verification;
  • attempted to circumvent Platform safeguards;
  • created financial or reputational risk.

Where appropriate, Crash N Go may provide notice and an opportunity to appeal.

44.Account Termination

Crash N Go may terminate an account for serious or repeated violations.

Users may terminate their account subject to outstanding obligations.

Termination does not eliminate obligations arising before termination.

45.Limitation of Platform Responsibility

To the maximum extent permitted by applicable law, Crash N Go is not responsible for losses arising solely from:

  • Host misconduct;
  • Guest misconduct;
  • inaccurate User-provided information;
  • unauthorized use of an Accommodation;
  • events beyond Crash N Go's reasonable control;
  • third-party services;
  • payment-provider failures;
  • internet or telecommunications failures.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

46.Assumption of Risk

Guests acknowledge that staying in private accommodations may involve ordinary risks, including:

  • stairs;
  • swimming pools;
  • balconies;
  • kitchens;
  • pets;
  • local traffic;
  • weather;
  • unfamiliar surroundings;
  • other ordinary property-related risks.

Guests are responsible for exercising reasonable care. Hosts must comply with applicable safety obligations.

47.Indemnification

To the maximum extent permitted by law, Users agree to indemnify and hold Crash N Go and its officers, directors, employees, agents, affiliates, and service providers harmless from claims, damages, liabilities, losses, costs, and expenses arising from:

  • violation of these Terms;
  • violation of law;
  • damage caused by the User;
  • fraudulent conduct;
  • infringement of third-party rights;
  • unauthorized use of the Platform;
  • inaccurate Listing information;
  • unauthorized property use.

This provision does not apply to the extent a claim is caused by Crash N Go's own unlawful conduct or liability that cannot legally be excluded.

48.Third-Party Services

Crash N Go may integrate:

  • payment processors;
  • identity verification providers;
  • mapping providers;
  • communication providers;
  • analytics services;
  • insurance providers;
  • customer support providers;
  • technology vendors.

Third-party services may have separate terms.

49.Platform Availability

Crash N Go does not guarantee uninterrupted Platform availability. The Platform may occasionally be unavailable due to:

  • maintenance;
  • upgrades;
  • security incidents;
  • telecommunications failures;
  • third-party failures;
  • natural disasters;
  • other events outside Crash N Go's reasonable control.

50.Force Majeure

Crash N Go will not be responsible for failure or delay caused by events beyond its reasonable control, including:

  • natural disasters;
  • war;
  • terrorism;
  • civil unrest;
  • government action;
  • pandemics;
  • major infrastructure failures;
  • telecommunications failures;
  • cyberattacks;
  • utility failures.

This does not eliminate rights that cannot lawfully be excluded.

51.Complaints and Dispute Resolution

Users should first submit complaints through Crash N Go's internal dispute-resolution process. Crash N Go will review complaints fairly and may request supporting documentation.

Under the Internet Transactions Act, digital platforms are required to maintain an effective redress mechanism, and the law contemplates exhaustion of the platform's internal redress process before escalation in applicable circumstances.

Crash N Go's internal complaint process will generally aim to resolve complaints within seven (7) calendar days, subject to the complexity of the matter, availability of evidence, and applicable law.

52.Governing Law

These Terms shall be governed by the laws of the Republic of the Philippines, unless applicable law requires otherwise.

Nothing in these Terms prevents a consumer from exercising rights that cannot lawfully be waived.

53.Venue

Subject to applicable consumer-protection laws and alternative dispute-resolution requirements, disputes that cannot be resolved through Crash N Go's internal process may be brought before a court or appropriate government agency having proper jurisdiction.

Crash N Go may designate the appropriate venue in its final published version, subject to applicable law.

54.Changes to These Terms

Crash N Go may modify these Terms from time to time.

Material changes will be communicated through appropriate means.

Continued use of Crash N Go after the effective date of revised Terms constitutes acceptance to the extent permitted by law.

55.Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective.

56.No Waiver

Failure by Crash N Go to enforce a provision does not constitute a permanent waiver of that provision.

57.Entire Agreement

These Terms, together with applicable Listing rules, Booking Agreement, Privacy Policy, Cancellation Policy, Host Agreement, Guest Rules, and other incorporated policies, constitute the agreement governing use of Crash N Go.

59.User Acknowledgment

By selecting "I Agree," creating an account, listing an Accommodation, submitting a Reservation, making a payment, accepting a Reservation, or otherwise using Crash N Go, the User acknowledges that:

  • they have read these Terms;
  • they understand these Terms;
  • they agree to be legally bound by these Terms;
  • they agree to applicable Crash N Go policies;
  • they will comply with applicable laws.
